Terms of Service
Welcome to The Collection (“the Site,” “we,” “us,” or “our”), operated by The Collection, presented by Aristocratix. These Terms of Service (“Terms”) govern your access to and use of the Site. By using the Site, you agree to be bound by these Terms. If you do not agree, you must not use the Site.
The Site is a multi-vendor e-commerce marketplace for fine art nude prints and original artworks, intended for adults only (18+). You must affirm you are 18+ upon entry. These Terms incorporate our Privacy Policy and are governed by California law.
1. Acceptance of Terms and Age Requirement
By creating an account, making a purchase, listing items as a vendor, or otherwise using the Site, you represent that you are at least 18 years old, have the legal capacity to enter into these Terms, and agree to comply with them. We reserve the right to refuse service or terminate accounts at our discretion, including for violations of these Terms.
2. Description of the Marketplace
The Site connects independent artists (“Vendors”) with buyers interested in fine art nude prints and originals. Vendors apply through the Nude Art LA curation process for approval before listing. The Company acts solely as a technology provider and marketplace facilitator — not as a seller, buyer, or guarantor of any products. All sales are direct between Vendors and Buyers. Vendors are independent contractors responsible for their content, fulfillment, and compliance.
3. Artist/Vendor Terms
Application and Onboarding: To become a Vendor, you must submit a Nude Art LA application including portfolio and bio. Approval is at our sole discretion. Approved Vendors receive access to Dokan tools for store setup.
Conduct and Listings: Vendors must list only original, high-quality fine art depicting the human form in an artistic, non-exploitative manner. All models must be 18+ with verifiable consent. Prohibited content includes:
- Child sexual abuse material (CSAM) or any depiction of minors in sexualized contexts — zero tolerance, immediate termination and reporting to authorities.
- Non-consensual content, deepfakes, or revenge pornography.
- Illegal, obscene, or infringing materials.
- Harassment, hate speech, or discriminatory content.
Commission and Fees: The Company charges a 20% platform fee on all sales. Vendors may set whether the fee is absorbed by them or passed to Buyers. Payouts are processed via Stripe Connect. Vendors are responsible for their own taxes.
Fulfillment: Vendors must fulfill orders promptly — digital within 24 hours, physical within 7–14 days.
Suspension/Termination: We may suspend or terminate Vendor accounts for violations. Vendors may appeal by emailing [email protected].
4. Buyer Terms
Purchases: All purchases are final unless the Vendor offers returns. Digital downloads are delivered via email or dashboard link; physical items ship per Vendor terms.
Refunds: Digital sales are non-refundable after delivery. Physical items may be returned within 14 days if defective or not as described. Chargeback abuse may result in account suspension.
Taxes: Buyers are responsible for applicable sales taxes, displayed at checkout.
5. Intellectual Property
Vendor Rights: Vendors retain all copyrights and ownership of their artworks. By listing, Vendors grant the Company a non-exclusive, worldwide, royalty-free license to display and promote listings on the Site.
Buyer Rights: Upon purchase, Buyers receive a limited, non-transferable personal use license. Prohibited: redistribution, commercial use, reproduction, modification, or use in AI training datasets without Vendor consent.
Infringement: Vendors must indemnify the Company against IP claims arising from their listings.
6. Prohibited Uses
You agree not to: access the Site if under 18; upload illegal or abusive content; interfere with the Site (hacking, bots, excessive scraping); use the Site for unauthorized commercial purposes; violate laws including copyright and privacy regulations; or impersonate others.
7. DMCA and Content Takedown
To report infringement, email [email protected] with “DMCA Notice” in the subject. Include your contact info, description of the work, location of infringing material, and a statement of good faith belief. We respond within 48 hours. Repeat infringers may have accounts terminated.
8. Payment Terms
All payments are processed via Stripe. The Company deducts a 20% commission before Vendor payouts. Payouts occur monthly (net 30) via Stripe Connect with a minimum $50 balance. Currency is USD.
9. Disclaimers and Limitation of Liability
The Site is provided “as is” without warranties. The Company disclaims liability for Vendor products, including quality, authenticity, or delivery. In no event shall the Company be liable for indirect, incidental, or consequential damages. Total liability is capped at $100 or the amount paid in the past 12 months, whichever is greater.
10. Dispute Resolution
Most disputes can be resolved informally by emailing [email protected]. If unresolved, you agree to binding arbitration under AAA rules in Los Angeles, California. No class actions. Governing law is California.
11. Termination
We may terminate or suspend access for violations without notice. Obligations including IP licenses, payment obligations, and dispute resolution survive termination.
12. Changes to Terms
We may modify these Terms at any time. Changes will be posted with the updated date. Continued use after changes constitutes acceptance.
